Terms of Educational Services
This document constitutes an official public offer (the “Offer”) by Italique Academy (hereinafter referred to as the “Provider”) to conclude a contract for the provision of educational services with any legally capable individual or legal entity (hereinafter referred to as the “Client”) under the terms set out below.
This Offer is issued in accordance with applicable civil law and international regulations and shall be deemed accepted (entered into force) upon acceptance by the Client.
1. General Provisions
1.1. The Provider of the services is Italique Academy, an online Italian language school providing educational services remotely via the website https://online-fda.com.
1.2. The Client is any person who accepts the terms of this Offer.
1.3. Acceptance of this Offer (“Acceptance”) is deemed to occur upon any of the following actions:
- payment for services via the Website;
- registration for a course, lesson, or consultation;
- submission of an online form confirming acceptance of this Offer.
1.4. By accepting this Offer, the Client confirms that they have read, understood, and fully agreed to its terms.
2. Subject of the Agreement
2.1. The Provider undertakes to provide the Client with online educational services (individual lessons, group lessons, online courses, exam preparation, consultations), and the Client undertakes to pay for such services.
2.2. Services are provided remotely using online platforms and digital tools (including but not limited to Zoom, learning platforms, video materials).
3. Fees and Payment Procedure
3.1. The current prices for services are published on the Website and form an integral part of this Offer.
3.2. Payment is made in a cashless form via the payment systems PayPal and WayForPay.
3.3. The Provider’s obligation to provide services arises upon successful receipt of payment.
3.4. The Provider does not store or process bank card details. All payment data is processed directly by PayPal and WayForPay in accordance with their privacy policies and PCI DSS security standards.
4. Service Delivery and Cancellation Policy
4.1. The format, duration, and schedule of lessons are determined by the selected course or agreed individually.
4.2. If the Client fails to attend a scheduled lesson or cancels less than 8 hours in advance, the lesson is deemed delivered and is not refundable.
4.3. If a lesson is cancelled due to the Provider’s fault, the Client will be offered a rescheduled lesson or equivalent compensation.
4.4. Access to recorded online courses is granted after full payment and is strictly personal.
5. Refund Policy
5.1. Refunds for services that have already been provided or started are not available.
5.2. Once access to an online course has been granted, refunds are not provided.
5.3. In exceptional cases, refund requests may be reviewed individually at the sole discretion of the Provider, without creating any obligation.
6. Rights and Obligations of the Parties
6.1. The Provider undertakes to:
- provide services in accordance with the description published on the Website;
- ensure the confidentiality of the Client’s personal data;
- inform the Client of any significant changes related to service delivery.
6.2. The Client undertakes to:
- provide accurate and truthful personal data;
- pay for services in a timely manner;
- comply with the rules of the learning process and standards of respectful communication.
7. Liability
7.1. The Provider shall not be liable for failure or delay in providing services due to reasons beyond its control, including technical failures or internet connectivity issues.
7.2. The Provider does not guarantee specific learning outcomes, as results depend on the Client’s individual abilities and efforts.
8. Intellectual Property
8.1. All educational materials, methodologies, videos, texts, and other content are the intellectual property of Italique Academy.
8.2. Any copying, distribution, or transfer of materials to third parties without the Provider’s prior written consent is strictly prohibited.
9. Personal Data Processing
9.1. Personal data is processed in accordance with the Privacy Policy published on the Website.
10. Term of the Agreement
10.1. This Agreement enters into force upon Acceptance of the Offer and remains valid until the Parties have fully performed their obligations.
11. Final Provisions
11.1. The Provider reserves the right to amend this Offer unilaterally. The current version is always available on the Website.
11.2. Any disputes shall be resolved through negotiations; if no agreement is reached, disputes shall be resolved in accordance with applicable law.
